fchai's total cumulative liability to any individual user for any claim arising out of or relating to these Terms shall not exceed the total net deposits made by that user in the twelve (12) months preceding the event giving rise to the claim.
fchai does not warrant that the platform will be available continuously, free from errors, or free from malware. The platform is provided on an "as is" and "as available" basis.
fchai reserves the right to suspend, restrict, or permanently close any user account, with or without prior notice, for reasons including but not limited to: breach of these Terms, suspected fraud or money laundering, failure to complete KYC verification, abuse of bonus programs, or receipt of a self-exclusion request from the account holder.
Upon closure of an account, any verified real-money balance (net of applicable bonus amounts subject to forfeiture) will be returned to the user via their most recently used verified payment method, subject to AML compliance review. These Terms shall be governed by and construed in accordance with the laws of the Philippines.
